Constance Hotels & Resorts #NewHotels Competition Terms & Conditions
These general terms and conditions (these Terms) apply to the Constance Hotels & Resorts #NewHotels Prize Draw (the Prize Draw) conducted and promoted by Constance Hotels & Resorts whose registered office is [Belle Mare, Poste de Flacq, Mauritius] through online entries only.
By providing your details to us (Constance Hotels & Resorts) and entering our Online Quiz and #NewHotels Prize Draw (the Competition), you confirm your agreement to be bound by these Terms which govern the whole contract governing the operation and your entry into the Competition.
1.1 You must be aged 18 or over to be eligible to enter the Competition.
1.2 Employees (and their families) of Constance Hotels & Resorts, affiliate companies, agencies, and any other company or persons directly connected with the development or administration of the Competition, are not eligible to enter.
1.3 You may enter the Competition from 19 January 2024. The closing date for receipt of entries is midnight GMT on 02 February 2024. Constance Hotels & Resorts accepts no responsibility for entries lost, damaged (for example by data corruption) or delayed entries, or for any inability to submit entries as a result of computer service, systems and or server failure, error, interruption, defect or delay or any other technical malfunction. Late, damaged, illegible, incomplete, corrupt or suspected fraudulent entries will not be accepted.
1.4 Constance Hotels & Resorts reserves the right in its absolute discretion to disqualify from the Competition any entrant who Constance Hotels & Resorts believes has not complied with these Terms or has not acted in good faith.
2.1 Entries shall be made in accordance with these Terms and shall be made online only.
2.2 Entrants must each follow the Constance Hotels & Resorts Instagram account and tag 1x Instagram account in the comments of the specified post.
2.3 The use of software that allows automatic, mechanical or multiple entries is not permitted. Constance Hotels & Resorts reserves the right to disqualify anyone using such software, or who otherwise affects the validity or operation of the Competition.
2.4 Constance Hotels & Resorts will select a winner at random by drawing a name from the entrants. Selection of a winner under this condition is final and no correspondence or discussion will be entered into.
2.5 If the winner does not come forward to claim his prize within 7 days or does not wish to accept his prize, a second name will be drawn at random and so forth until a winner has accepted.
3.1 The prize will be a stay at either Constance Tekoma or Constance Sakoa Boutik, with the time frame and specific accommodation dictated by Constance Hotels & Resorts. This does not include flight costs or any other remuneration.
The Prize: 3 nights stay for two on a Half Board basis. All stay are subject to hotel availability and during off-peak season.
3.2 Constance Hotels & Resorts reserves the right at any time to cancel or change the Competition in any way if, at its sole discretion, it considers it necessary to do so.
3.3 Except for any liability arising in relation to death or personal injury resulting from the negligence of the Constance Hotels & Resorts or its employees, Constance Hotels & Resorts shall have no liability in respect of any loss, harm or damage whatsoever (including but not limited to direct, indirect and consequential loss) arising in connection with the Competition to any person who has made or wished to make an entry into the Competition or any third party.
3.4 There is no fee payable for entering the Competition or receiving the prize.
3.5 Constance Hotels & Resorts reserves the right to withdraw a prize or provide alternative prizes of equal or greater value. In all cases the Constance Hotels & Resorts’ decision is final. No cash alternative can be substituted for the prize.
4.1 Constance Hotels & Resorts will undertake a random draw of entries made to the Prize Draw.
Constance Hotels & Resorts will notify the winner of each Prize Draw via the Instagram handle submitted during entry within 3 working days of the closing date. If you are chosen as a winner and your contact details have changed since your entry, Constance Hotels & Resorts reserves the right to disqualify your entry and draw an alternative winner. Full details of the prizes and how to claim will be included with this notification.
Winner will be contacted on 6th of February 2024 and revealed after they have claimed their prize on the 6th February 2024.
4.2 Constance Hotels & Resorts may request that the winners contact us to confirm that they are a winning entrant and or to provide proof of identity, age and residency. In the event of a dispute as to your identity, your entry will be deemed to have been submitted by the authorised holder of the email account from which the entry was submitted. The winner may be requested to provide Constance Hotels & Resorts with proof that the winner is the authorised holder of the email account associated with the winning entry. No prize shall be released until Constance Hotels & Resorts is satisfied in its reasonable opinion of the identity of the proposed recipient.
4.4 If any of the following circumstances apply, the winner(s) will be deemed to have forfeited the prize and an alternative winner(s) will be selected at random from the remaining eligible entries in accordance with these Terms:
(a) the prize (or any correspondence relating thereto, e.g. an email from us confirming that a winning entry) is returned as non-deliverable;
(b) the winner does not respond to a request to contact Constance Hotels & Resorts within 7 days of such request being sent;
(c) the winner does not provide requested evidence to Constance Hotels & Resorts’ satisfaction (acting reasonably) of identity, age, residency or parental or guardian’s consent to Constance Hotels & Resorts' satisfaction within 7 days of such request being sent; or
(d) Constance Hotels & Resorts suspects non-compliance with any of the Terms.
4.5 Constance Hotels & Resorts' decision is final and binding in every situation including any not covered in these Terms and no correspondence or discussion will be entered into.
4.6 Constance Hotels & Resorts reserves the right to disqualify an entrant and/or winner as set out in these Terms or otherwise in its absolute discretion and if it does then Constance Hotels & Resorts shall be entitled to replace such disqualified entrant with a replacement using the same registration process and subject to these Terms.
4.7 The winners name(s) may be published on the Constance Hotel & Resorts' website, Instagram/Facebook page.
4.8 By entering the Competition, you warrant that all details submitted to Constance Hotels & Resorts including (without limit) your name, address, age and all other information submitted during the registration process for the Competition or otherwise requested by Constance Hotels & Resorts are true and accurate.
4.9 By entering this Competition you agree that your personal details may be stored and otherwise processed by Constance Hotels & Resorts for the purposes of administering the Prize Draw and in the event of being a winner in any Prize Draw for publicity purposes. [2]
5.1 Use of personal information
5.1.1 By registering to the competition and accepting the T&Cs, you give us permission to contact you via your Instagram account and email address if you are the winner.
5.1.3 Constance Hotels & Resorts will be storing your Instagram UID in accordance with the permissions granted when you register to the competition and accept the T&Cs. This is in order to contact the winner of the competition. Constance Hotels & Resorts will not use any of this data for marketing purposes or pass on this content.
